As a victim of product defects, you have options

When a product you purchase is defective, it could pose a hazard to your health. As a consumer, you have the right to pursue compensation if you've been harmed because of a defective product or because the manufacturer or seller did appropriately warn you of the risks of using the product.

There are dozens of kinds of defective products, including things like:

  • Sporting equipment
  • Cribs
  • Furniture
  • Vehicles
  • Dangerous drugs
  • Foods
  • Toys

There are three kinds of defects you may be able to make a claim over. They include:

  • Defects in design
  • Defects in warnings
  • Defects in manufacturing

The legal remedies you have will rely on the kind of defect that occurred as well as how you were affected. You should also be aware that manufacturers can be held strictly liable for product defects that happened while they were being manufactured. As a victim, it isn't your responsibility to prove negligence. Instead, you just need to show that there was a manufacturing errors that resulted in injuries.

You may also be able to file a claim and be compensated if you can prove negligence. For example, showing that a toy wasn't tested properly before being placed on the market may show negligence and be able to help your case.

It's horrible to think that anyone should have to be injured because of defects, but injuries do happen often. If you or someone in your family are harmed because of product defects, it may be a good idea to get to know your legal rights and the avenues you can pursue to seek compensation.
